Terms of Service

Please read these terms carefully before downloading, purchasing, or using Inscura. By using the service, you agree to be bound by them.

1. Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and DooFox LTD, a company registered in England & Wales under company number 17193256 with its registered office at Office 15270, Initial Business Centre, Unit 7 Wilson Business Park, Manchester, M40 8WN, United Kingdom (“we”, “us”, or “our”), governing your use of the Inscura desktop application, the inscura.app website, and any related services we offer (collectively, the “Service”).

By downloading, installing, accessing, or purchasing any part of the Service, you acknowledge that you have read these Terms, understand them, and agree to be bound by them. If you do not agree, you must not use the Service.

2. Eligibility & Account

You must be at least 16 years old, or the age of digital consent in your jurisdiction (whichever is higher), to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract.

Some features — including purchase, license activation, and Inscura Cloud — require an account. Account sign-in uses a time-limited link sent to your email address. You agree to provide accurate, current, and complete information when registering, and to keep your email account and sign-in links secure. You are responsible for all activity that occurs under your account.

Notify us immediately through inscura.app/contact if you suspect unauthorized access to your account.

3. License Grant

Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Inscura on the number of devices included in your purchased tier, solely for your personal, non-commercial use.

  • Free — 1 device, no payment required.
  • Solo — 1 device, one-time payment.
  • Trio — up to 3 devices, one-time payment.
  • Studio — up to 5 devices, one-time payment.

Paid licenses are perpetual and include lifetime free upgrades to future versions of the desktop application — major and minor — on the devices your license covers, as further described in Section 8.

Licenses are issued to a single end user and are not transferable, resellable, or assignable unless we expressly authorize the transfer in writing.

4. License Restrictions

You agree not to, and not to permit any third party to:

  • copy, modify, or create derivative works of the Service, except where expressly permitted by an open-source license that ships with a specific component;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except to the extent applicable law expressly permits despite this limitation;
  • rent, lease, lend, sell, sublicense, or otherwise commercially exploit the Service or any license key;
  • share, publish, or distribute your license key or activation credentials;
  • circumvent, disable, or interfere with security or licensing features of the Service;
  • use the Service to build a competing product or service; or
  • use the Service in any way that violates applicable law or these Terms.

5. Pricing & Payment

Prices for the desktop license tiers are one-time payments stated in U.S. dollars on the pricing page and are exclusive of any sales tax, VAT, GST, or other transaction tax that may apply in your jurisdiction. You are responsible for any such taxes.

Payments are processed through Waffo. By purchasing, you authorize us and our processor to charge the payment method you provide. We do not store full payment-card numbers on our servers.

Plans cannot be changed, upgraded, or downgraded after purchase. Please choose the device tier that fits your setup before completing checkout.

6. Refund Policy

14-day no-questions-asked refund. If you are not satisfied with a paid desktop license, you may request a full refund within fourteen (14) days of the original purchase. No justification is required.

To request a refund, submit your request through inscura.app/contact from the email address used at checkout, including your order number. The corresponding license key is deactivated only after the payment provider confirms that the full refund has succeeded. Submitting or approving a refund request does not mean that the refund is complete.

The 14-day refund window does not apply to:

  • Inscura Cloud renewals after they have been activated, except where required by applicable consumer-protection law;
  • purchases obtained through fraudulent means, charge-backs, or in violation of these Terms; or
  • requests made more than 14 days after the original transaction date.

Nothing in this section limits any non-waivable refund rights you may have under your local law.

Consumers in the European Economic Area, the United Kingdom, and other jurisdictions with a statutory right of withdrawal: by initiating the download or activation of a paid license, you expressly request that we begin performing the contract immediately and acknowledge that, once download or activation has begun, you lose the statutory right of withdrawal in respect of the supply of digital content (Article 16(m) of EU Directive 2011/83/EU and equivalent local law). Our voluntary 14-day refund policy described above continues to apply alongside this acknowledgement.

7. Inscura Cloud

No Inscura Cloud features or services are currently available. Future features, services, and renewal pricing have not yet been determined. Cloud entitlements and any separately chosen subscriptions are managed through your account, separately from the desktop license.

Paid Solo, Trio, and Studio licenses include a free first year of Cloud service. When Cloud services launch, this free period will restart for existing license holders, providing a full three hundred sixty-five (365) days from launch regardless of the original purchase date. Time before launch does not count toward the included free year.

Renewal after the included free year is optional. The included entitlement expires without automatically becoming a paid subscription or charging your payment method. Any separately chosen Cloud subscription is subject to the price and renewal terms shown at checkout and can be managed through your account. We will send a renewal reminder to the email address associated with your account before the included period ends.

Cloud entitlements are tied to your account and license. You agree not to share any service credentials issued to your account, exceed reasonable rate limits, or use them for purposes other than their intended personal use.

We may suspend or revoke access to Cloud services if we reasonably believe they are being used in a way that materially threatens the stability, security, or legality of the Service, with reasonable advance notice where practicable.

Paid desktop features still require the appropriate desktop license. Your permanent Inscura desktop license does not depend on, and will not be revoked because of, the absence or non-renewal of Cloud services.

8. Updates & Lifetime Upgrades

Once activated, your paid Inscura license unlocks every future version of the desktop application for the lifetime of the product, on the devices your license covers, with no upgrade fees and no expiry.

Updates may include bug fixes, performance improvements, new features, security patches, or changes that modify or remove existing functionality. We may also update the dependencies, third-party services, or system requirements of the application; older operating systems may eventually fall out of support.

You are not required to install any update, but unsupported versions may not function correctly with current third-party services and may not receive security fixes.

9. Your Library & User Content

Inscura is designed to organize media files that you already have on your local devices. We do not host, transmit, or distribute your media files as part of the desktop library. Library information is stored on your computer. If you configure an external storage service and choose to upload resources, those files are sent to that service; online movie-information and translation features also send the request data needed by the configured provider.

You are solely responsible for the content of your library and for ensuring that you have the legal right to store, use, and (if applicable) make backup copies of every file it contains. We do not claim any ownership over your library or the metadata you add to it.

If you submit feedback, bug reports, or feature suggestions to us, you grant us a perpetual, royalty-free, worldwide license to use, modify, and incorporate that feedback into the Service without obligation to you.

10. Acceptable Use

You agree not to use the Service to:

  • store or organize content you do not have a legal right to possess;
  • infringe the intellectual property, privacy, or other rights of any person or entity;
  • upload or process content that is unlawful, defamatory, obscene, or that depicts the sexual exploitation or abuse of minors;
  • introduce malware, use automated means to access the Service in excess of reasonable limits, or attempt to disrupt the Service; or
  • access any account, system, or data without authorization.

We reserve the right, but have no obligation, to investigate suspected violations and to take appropriate action, including suspending or terminating accounts and licenses, with or without notice.

11. Third-Party Services & Open-Source Components

The Service integrates with or relies on third-party services (for example, payment processors, optional metadata providers, anti-abuse services, and content-delivery networks). Their availability is outside our control, and your use of them is subject to their own terms and privacy policies.

Some components of the desktop application and the self-hosted scraper are made available under open-source licenses. Those licenses, when present, prevail over these Terms with respect to the corresponding component. Notices and license texts are included in the application or the public source repository.

12. Intellectual Property

The Service, including the Inscura desktop application, the website, the brand, the logo, and all related materials, is owned by DooFox LTD or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.

Inscura, the brand wordmark, and any associated logos are trademarks of DooFox LTD. You may not use them without our prior written consent, except for fair-use references that comply with applicable law.

13. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not warrant the accuracy or completeness of metadata returned by any scraper, official or community, and we are not responsible for the content, accuracy, or availability of any third-party service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DOOFOX LTD, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100).

The exclusions and limitations in this Section 13 do not apply to: (i) liability for death or personal injury caused by our negligence; (ii) liability for fraud or fraudulent misrepresentation; (iii) our gross negligence or willful misconduct; or (iv) any other liability that cannot be excluded or limited under applicable law.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the foregoing exclusions and limitations apply only to the extent permitted by law.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless DooFox LTD, its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service in breach of these Terms, (b) your violation of any third-party right, including any intellectual-property right or privacy right, or (c) any content in your library that you do not have the legal right to possess.

This indemnity does not apply to the extent any claim arises from our gross negligence, willful misconduct, or breach of these Terms. We will give you prompt written notice of any claim for which we seek indemnification, allow you to control its defense and settlement (provided that any settlement does not impose a non-monetary obligation on us without our prior written consent), and reasonably cooperate at your expense.

Where you are acting as a consumer and applicable consumer-protection law restricts or prohibits indemnity obligations imposed on consumers, this Section 14 applies only to the maximum extent permitted by that law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access to all or part of the Service, including any paid license, if you materially breach these Terms, if your account is used to violate applicable law, or if continued provision of the Service to you would expose us or other users to legal or security risk.

Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — will survive.

16. Governing Law & Disputes

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of England and Wales, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to the informal-resolution step below, the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, and you submit to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual-property or confidentiality rights.

Before filing a claim, you agree to first contact us through inscura.app/contact and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Any claim must be brought within one (1) year after the cause of action arises; otherwise it is permanently barred, except where applicable law prohibits a shorter limitation period than the statutory default.

Consumer protections. Nothing in this Section 16 deprives you, as a consumer, of the protection of any mandatory provisions of the law of the country in which you have your habitual residence, including your right to bring proceedings in, and to have disputes resolved by, the courts of that country where applicable consumer-protection law so requires. The choice of English law and forum applies only to the extent that it does not override such mandatory rights.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. For material changes, we will provide reasonable notice — for example, by updating the website, sending an email, or showing an in-app notice — before the changes take effect.

If you continue to use the Service after the changes take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service. Your existing perpetual license rights will not be retroactively reduced for usage prior to the effective date of the updated Terms.

18. Copyright Infringement Notices

We respect the intellectual-property rights of others and expect users of the Service to do the same. The Inscura desktop application is designed to organize media files that already reside on a user’s own devices; we do not host, transmit, or distribute end-user media files. We will respond to properly submitted notices of claimed copyright infringement involving any content actually hosted on inscura.app or its sub-domains in accordance with applicable law, including the UK Copyright, Designs and Patents Act 1988 and, where applicable to materials hosted in the United States, the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512).

A notice of claimed infringement must be submitted in writing through inscura.app/contact and must include:

  • a physical or electronic signature of the rights holder or a person authorised to act on the rights holder’s behalf;
  • identification of the copyrighted work claimed to have been infringed;
  • identification of the allegedly infringing material and information sufficient to allow us to locate it (such as a specific URL on inscura.app);
  • your contact information, including address, telephone number, and email address;
  • a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law; and
  • a statement that the information in the notice is accurate and that you are authorised to act on behalf of the rights holder.

Materially false or abusive notices may give rise to liability under applicable law. Counter-notices may be submitted through the same channel. It is our policy, in appropriate circumstances, to disable accounts of users who are determined to be repeat infringers.

19. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or, if it cannot be modified, severed from these Terms. The remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation issued to you, constitute the entire agreement between you and DooFox LTD regarding the Service and supersede all prior or contemporaneous agreements, communications, marketing statements, and proposals, whether oral or written. No statement or representation made by any sales, marketing, or support channel forms part of these Terms unless it is expressly incorporated in writing.

21. No Waiver

Our failure to enforce any right or provision of these Terms will not be construed as a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of DooFox LTD, and a waiver in one instance does not constitute a waiver of any subsequent breach or default.

22. Assignment

You may not assign, transfer, or delegate these Terms or any of your rights or obligations under them, in whole or in part, without our prior written consent. Any purported assignment in violation of this section is void. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, or to any affiliate, subject to applicable law.

23. Notices

Unless these Terms require otherwise, all notices to you may be given by email to the address associated with your account, by posting to the inscura.app website, or by an in-app message. Notices to us must be sent through inscura.app/contact, and are effective when received. You are responsible for keeping your account email address current.

24. Force Majeure

Neither party will be liable for any failure or delay in performance under these Terms (other than your obligation to pay fees) caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil disturbance, labor disputes, internet or telecommunications failures, government actions, or pandemic-related restrictions. The affected party will use reasonable efforts to resume performance as soon as practicable.

25. Language

These Terms are drafted in English. Any translation provided is for convenience only. In the event of any inconsistency between the English version and a translation, the English version controls to the extent permitted by applicable law.
